Terms & Conditions & Risk Waiver – Primal Adventures Trek Fitness Training/Wild Hikes

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE TICKING ‘I AGREE’

1. I understand that participating in PRIMAL ADVENTURES TREK FITNESS TRAINING OR WILD HIKES (“Training”) involves walking or running on roads and paths, uneven surfaces and taking part in strenuous exercises. I am aware of the hazards involved. The hazards include, but are not limited to, road or track surfaces, remoteness from assistance or medical aid, the extremely strenuous nature of endurance, strength and power exercises, becoming lost, vehicle traffic, actions of participants, spectators, organiser’s personnel, supporting agencies, weather conditions, heat exhaustion, condition or suitability of participant’s clothing, footwear or equipment. In my judgment I have sufficient competence and experience to participate safely in Training.
2. I certify that I am physically fit, have sufficiently trained for participation in this Training and have not been advised otherwise by a qualified medical person.
3. On behalf of myself, my executors, administrators, heirs, next of kin, successors and assigns, I:
a. RELEASE AND DISCHARGE; Primal Adventures and each of the Trainers, volunteers, community organisations and all State, Federal and Local Government authorities with responsibility for the locality in which the event may be staged and their or its respective officers, directors, employees, independent contractors, representatives, agents and volunteers (Indemnified Parties) from any and all liability for death, disability, personal injury, property damage, property theft and all other loss or injury whatever and however occurring which I may suffer as a result of or in connection with, directly or indirectly, my participation in and my travelling to and from this event and I waive all and any claims against the Indemnified Parties which but for the execution of this Acknowledgement Waiver and Release I may have had against the Indemnified Parties or any of them;
b. INDEMNIFY AND HOLD HARMLESS the persons or entities mentioned in paragraph 3a from any and all liabilities, claims or actions (including negligence) whatever or however caused which may be brought against them or any of them arising as a result of or in connection with, directly or indirectly, my participation in and travelling to and from this training, including any claim by any person assisting me.
4. I hereby consent to receive medical treatment which may be deemed necessary in any event of injury, accident and or illness during the training
5. I agree to abide by the Training rules and I understand that my session may be discontinued if through my actions or behaviour, in the opinion of the organisers, I break any of the rules or I bring the training into disrepute. I further understand that the organisers reserve the right to reject any registration without having any justification for their actions.
6. I give my consent for any photos, video or other promotional material to be used by Primal Adventures on their website, Facebook page or for any other marketing purpose. I can also inform the organiser that I do not give consent.
7. In agreeing to this, I acknowledge that I have been cleared by a Doctor to participate in strenuous exercise if I have any medical conditions. I will provide any medical details below that may impact on my participation in strenuous exercise.
8. Cancellation Policy – More than 48 hours prior to session you may cancel or postpone your session and receive a full refund of any cash paid. 24-48 hours prior, 80% refund. 12-24 hours prior, 70% refund. Less than 12 hours prior, no refund. There are no refunds or transfers from any Discover NSW or Parent NSW vouchers used for your booking.
9. Late Arrivals – Due to the nature of Trek fitness Training being a mobile event, we have provided a map and specific location for the start. If you are not on time, the group may depart and you will miss the session.
10. I consent to Primal Adventures adding me to their mailing list to receive updates on trips. This information will only be used in accordance with their Privacy Policy as shown on the website.
